P2P gambling laws
Is P2P gambling legal? Laws by country
Is P2P gambling legal? The answer depends on where you are when you play, not on where the site holds its licence. This page sets out the position in the UK, the US, Canada, Australia, India and three EU countries as of October 2026, then shows how to check an offshore licence on the regulator's own register.
The short answer
Legal where your own country licenses the format and the site holds that licence. A Curaçao, Anjouan or Tobique licence lets a company operate from that jurisdiction; it does not make the site legal in the UK, Australia, India or a US state. The UK Gambling Commission states that serving British consumers without its licence is a criminal offence.
Is P2P gambling legal where you live?
Each country licenses for its own residents, and many license some P2P formats but not others. The table gives the position for each market and the register that settles it.
| Country | Where P2P gambling stands | Where to check a site |
|---|---|---|
| United Kingdom | Legal with a Gambling Commission licence for the game. Poker runs under a remote casino licence; exchanges and prediction markets under a betting intermediary licence. Unlicensed operators commit a criminal offence. | Gambling Commission public register |
| United States | Decided state by state. Online casinos were lawful in seven states in 2025, and online poker is licensed state by state. Prediction markets are federally regulated by the CFTC and contested by states. Paid skill contests run in most states, with exclusions. | Your state regulator; the CFTC list of designated contract markets |
| Canada (Ontario) | Legal on sites registered with iGaming Ontario, for players aged 19 or over who are physically in Ontario. The directory has poker, bingo and betting exchange categories. | iGaming Ontario directory |
| Australia | Online casinos, including online poker and PvP casino games, are prohibited. Licensed wagering, including a betting exchange, is allowed, without credit cards or crypto. | ACMA's register of licensed wagering providers |
| India | Every online game played for money has been banned since 1 May 2026, whether it is skill, chance or both. There is no licensing route. | None: no licence is available |
| Germany | Online poker, virtual slots and casino games are licensable. A cross-provider deposit limit of normally at most €1,000 a month applies. | GGL Whitelist |
| Netherlands | The KSA licenses casino games where players play against each other. | KSA Kansspelwijzer |
| Sweden | Every operator serving Swedish players needs a Swedish licence. | Spelinspektionen licensregister |
Is peer to peer betting legal in the US?
US gambling law is mostly state law. The federal Unlawful Internet Gambling Enforcement Act (UIGEA) works through payments: its Regulation GG defines unlawful internet gambling as a bet that is illegal under federal or state law where it is placed or received. UIGEA legalises nothing and bans nothing by itself, so the state you are standing in decides whether a P2P game is legal for you.
Online casinos and poker
According to the American Gaming Association, real-money online casinos were lawful in seven states in 2025. Online poker is licensed state by state, usually within the same iGaming regimes; Nevada licenses online poker only. Maine passed iGaming legislation in 2025 that became law on 11 January 2026 (LD 1164, enacted without the Governor's signature). An offshore licence does not fill the gap: ACR Poker's Anjouan licence, for example, excludes the US.
The sweepstakes crackdown
Dual-currency sweepstakes casinos, which sell one currency and give away a second that can be redeemed for prizes, are being banned state by state. The AGA counts five explicit bans passed in 2025: California, Connecticut, Montana, New Jersey and New York. California's AB 831 took effect on 1 January 2026, and New York's S5935A was signed on 5 December 2025. Trade press reports that Indiana, Iowa, Louisiana, Maine, Oklahoma (effective 1 November 2026) and Tennessee followed in 2026. This matters for P2P because some case battle sites describe themselves as sweepstakes; Clash.gg does.
Fantasy and 1v1 wagers
Head-to-head daily fantasy is regulated state by state, and DraftKings does not run in every state. GamerSaloon and Players' Lounge sell 1v1 video-game matches as skill contests and list the states that bar cash play. Kutt, a friend-versus-friend betting app, says it is available in 37 states plus DC.
Are prediction markets legal?
In the US, prediction markets are federally regulated exchanges. KalshiEX LLC has been a CFTC designated contract market since 2020. QCX LLC, trading as Polymarket US, was designated on 9 July 2025, and an amended order in November 2025 allows access through intermediaries. Polymarket's international crypto site is a separate product: it blocks 39 countries including the US and the UK, treats VPN use as a breach of its terms and states that it is not regulated by the CFTC.
The open question is whether states can still apply gambling law to sports contracts on these exchanges. The federal appeals courts are split:
- 3rd Circuit, 6 April 2026: sided with Kalshi against New Jersey, holding that federal law likely pre-empts the state (a preliminary injunction, not a final judgment).
- 9th Circuit, 28 August 2026: ruled against Kalshi in Nevada, holding that the Commodity Exchange Act likely does not pre-empt Nevada's gaming rules.
- 6th Circuit, 25 September 2026: let Ohio and Tennessee enforce their sports-betting laws against Kalshi.
- US Supreme Court: New Jersey's petition, No. 26-299, is pending, with Kalshi's response due on 9 November 2026.
The CFTC itself proposed a rule on 10 June 2026 setting a framework for event contracts that involve gaming. Outside the US the position is simpler. The UK Gambling Commission said in February 2026 that prediction markets appear to be betting intermediaries that need its licence, and India's 2025 Act covers them as online money games. The mechanics and fee formulas are in the prediction markets guide.
Are betting exchanges legal in the US?
The exchanges Europeans know do not serve Americans: Betfair Exchange, Smarkets and Matchbook all exclude the US in their terms. The peer-to-peer route Americans have is the CFTC-regulated event-contract exchange, where you buy Yes or No shares from other users and the exchange takes a trading fee. The UK model is covered in the P2P sports betting guide.
Is skill based gambling legal?
In most US states, paid skill contests run as non-gambling, and the operators themselves exclude the states they consider unsafe. Their lists differ, which is why the same app can be open to you on one platform and closed on another. Each list below is the operator's own, taken from its terms; none is a court ruling.
| Platform | States without cash play |
|---|---|
| Skillz | Arkansas, Connecticut, Delaware, Louisiana, South Dakota. Card games also barred in Indiana and Maine. |
| Papaya Gaming | Prizes cannot be redeemed in Arizona, Louisiana and Michigan (all games), Montana (Solitaire Cash and Bingo Cash) and Maine (card games). |
| Kokomo | Washington, Montana, Arizona, Arkansas, Connecticut, Delaware, Louisiana, South Dakota, Tennessee. |
| ProfitChess | Arizona, Arkansas, Connecticut, Indiana, Iowa, Louisiana, Maryland, Montana, South Carolina, South Dakota, Tennessee. |
Arkansas, Connecticut, Louisiana and South Dakota appear on the Skillz, Kokomo and ProfitChess lists alike, and Louisiana is on all four. In April 2026 a US federal jury found Papaya Gaming liable for false advertising for not disclosing bots in its tournaments.
Elsewhere, skill is no defence. In Great Britain, section 6 of the Gambling Act 2005 counts a game that mixes skill and chance as a game of chance, so backgammon or rummy for money needs a licence. India's 2025 Act bans online money games “irrespective of whether such game is based on skill, chance, or both”. The game-by-game picture is in the chess and backgammon guides.
Is crypto gambling legal?
Paying in crypto does not change which law applies. The question is still whether the site is licensed where you live, and for most crypto P2P sites the answer is no.
- UK: crypto is not banned, but a licensee must notify the Gambling Commission before taking it.
- US: no federal licence covers offshore crypto casinos. Under Regulation GG, a bet is unlawful if it breaks the law of the state where it is placed.
- Australia: licensed wagering operators have been barred from taking crypto or credit cards since 11 June 2024. Offshore crypto casinos are prohibited services, and ACMA has blocked 1,822 illegal gambling and affiliate sites since November 2019.
- India: crypto-funded play is still play for stakes, so the 2025 ban applies.
P2P gambling laws in Canada, Australia, India and the EU
Canada: Ontario
The Criminal Code bans most gambling but lets provinces conduct and manage lottery schemes. Ontario does this through iGaming Ontario, which contracts private operators registered with the AGCO: 49 operators and 84 sites as of 1 September 2026. Players must be 19 or over and physically in Ontario. The directory has Poker, Bingo and Betting Exchange categories, and STX is listed as an exchange. In November 2025 the Ontario Court of Appeal ruled 4-1 that the model stays lawful if Ontario players share games with players outside Canada, which clears the way for international poker pools. This page covers Ontario only.
Australia
The Interactive Gambling Act 2001 makes it illegal to offer Australians online casinos (including online pokies), online in-play sports betting, sports betting from unlicensed providers and betting on lottery outcomes. Online poker and PvP casino games fall under the online casino ban. Licensed wagering, including a betting exchange, is legal. Parliament passed further reforms on 19 August 2026, most of which start on 1 January 2027.
India
The Promotion and Regulation of Online Gaming Act, 2025 bans offering, advertising and processing payments for online money games, meaning any online game played for stakes. It took effect on 1 May 2026 with its Rules and a new Online Gaming Authority. Cash rummy, poker, ludo, fantasy contests and PvP crypto games are all covered. Government press releases put the penalty for offering a money game at up to three years in prison, a fine of up to ₹1 crore, or both. A challenge to the Act is pending before the Supreme Court.
EU snapshot
There is no EU-wide licence: each member state licenses its own market, and an offshore site without a national licence is unlicensed there. In Germany the joint authority GGL licenses online poker and virtual slots, while online casino games are licensed by the individual states; licensed sites are on the GGL Whitelist, and players face a cross-provider deposit limit of normally at most €1,000 a month. The Netherlands' KSA licenses casino games where players play against each other, lists legal sites in the Kansspelwijzer and runs the Cruks self-exclusion register, with a minimum exclusion of six months. Sweden requires a Swedish licence for every operator on its market, listed in Spelinspektionen's licensregister.
How to verify an offshore licence
Crypto P2P sites that hold a licence usually hold an offshore one. Checking it takes a few minutes and tells you who runs the site and which countries the licence excludes. Always reach the register by typing the regulator's address yourself, not through a link on the operator's site.
| Regulator | Where to check | What must match |
|---|---|---|
| Curaçao Gaming Authority | Click the seal in the site footer: a real one opens on cert.cga.cw. Then find the company in the licence register on cga.cw. | The N.V. or B.V. company name and the OGL/ licence number. The LOK regime has run since 24 December 2024; an old NOOGH sublicence from a master licensee is not an LOK licence. |
| Anjouan | Verify a Licence on anjouangaming.com (anjouangaming.org redirects there). Search by licence number, company or domain. | Status, B2C type and the domain. Check the Suspended and Revoked lists too. Look-alike domains exist, so type the address yourself. |
| Tobique Gaming Commission | The licence-holder page on thetgc.ca. | The company name. The page lists holders, licence type and a date but no licence numbers, so the footer company must match exactly. |
| Malta Gaming Authority | Licensee Register and URL Checker on mga.org.mt. | The exact domain, listed and active. A Type 3 licence is the P2P class: poker, bingo, betting exchanges and commission-based games. |
| Isle of Man GSC | Online Gambling Licence Holders register on isleofmangsc.com. | The domain must appear in the holder's profile. A company name alone is not enough; check Former Licence Holders as well. |
| Kahnawà:ke Gaming Commission | Permit Holders list on gamingcommission.ca. | The operator and its exact URL. The list header still says it was updated in 2023, so read the suspension notices on the home page too. |
Red flags
- The seal is a static image that opens nothing, or opens a page on a domain other than the regulator’s own.
- The company name in the footer differs from the name on the register.
- The register shows the licence as suspended, revoked or expired.
- The domain you are using is missing from the licence holder’s profile.
- The licence or the site’s terms exclude your country. Anjouan seal checks list excluded countries: the licences of CoinPoker and ACR Poker, for example, exclude the UK, the US, Australia, France, the Netherlands and Spain.
Every licensed site P2P Rivals links to has passed this check on the date shown on its card. How we review explains the rest of the process.

P2P gambling law questions
Is P2P gambling legal?
It depends on where you are when you play. The UK, Ontario, Germany, the Netherlands and Sweden license P2P poker, and the UK and Ontario also license betting exchanges; Australia bans online casino games including poker; India bans every real-money online game. A site's offshore licence does not change the law where you live.
Is peer to peer betting legal?
In the UK it is legal through an exchange holding a betting intermediary licence, such as Betfair Exchange, Smarkets or Matchbook. In the US, peer-to-peer trading on outcomes runs through CFTC-regulated event-contract exchanges such as Kalshi and Polymarket US, and several states dispute their sports contracts in court.
Are betting exchanges legal in the US?
The UK exchanges Betfair, Smarkets and Matchbook all exclude the US in their terms. Americans trade outcomes on CFTC-designated exchanges instead, and federal appeals courts are split on whether states can still apply gambling law to sports contracts on them.
Are prediction markets legal?
In the US, Kalshi and Polymarket US are CFTC-designated contract markets, though the 9th and 6th Circuits have let Nevada, Ohio and Tennessee apply their gambling law to sports contracts. In the UK the Gambling Commission treats prediction markets as betting intermediaries that need a licence. In India they fall under the 2025 ban on online money games.
Is skill based gambling legal?
In most US states paid skill contests run outside gambling law, but operators bar cash play in states such as Arkansas, Connecticut, Louisiana and South Dakota. In Great Britain a game that mixes skill and chance counts as gaming and needs a licence. India has banned online skill games for money since 1 May 2026.
Is crypto gambling legal?
Not in Australia, where offshore crypto casinos are prohibited services and licensed wagering cannot take crypto, and not in India. The UK allows crypto in principle, once a licensee has notified the Gambling Commission. In the US, legality depends on the law of the state where the bet is placed.
Does a Curaçao or Anjouan licence make a site legal in my country?
No. An offshore licence lets a company operate from that jurisdiction and nothing more. If your country requires a local licence, a site without one is unlicensed for you, and the licence itself often lists your country as excluded.
